(s'obre en una nova pestanya)\" href=\"https:\/\/fefac.cat\/empresarial\/claus-sessio-registre-jornada-pimec\/\" target=\"_blank\"> l&#8217;obligaci\u00f3 de tot empresari d&#8217;establir un sistema de registre horari de la jornada.<\/a><\/strong> <\/p>\n\n\n\n<p><strong>Sancions de 626 a 6250 euros<\/strong><\/p>\n\n\n\n<p><strong>L&#8217;incompliment d&#8217;aquesta obligaci\u00f3 est\u00e0 tipificat com a infracci\u00f3 greu, i podr\u00e0 ser sancionat amb una multa de 626 a 6250 euros<\/strong>. Els criteris de graduaci\u00f3 que podrien aplicar-se s\u00f3n el nombre de treballadors afectats o la xifra de negoci. \u00c9s a dir, a major xifra de facturaci\u00f3, major import de la sanci\u00f3.<\/p>\n\n\n\n<p><strong>Contractes a temps parcial<\/strong><\/p>\n\n\n\n<p>Cal tenir en compte que, en cas d&#8217;incompliment de les obligacions de registre, el contracte presumir\u00e0 celebrat a jornada completa. Es comunica la variaci\u00f3 de la clau de contracte a la tresoreria, que pot liquidar la difer\u00e8ncia entre temps parcial i complet. Ho pot fer en el per\u00edode m\u00e0xim, que s\u00f3n 4 anys, i en el temps que no s&#8217;hagi cobert l&#8217;obligaci\u00f3.<\/p>\n\n\n\n<p><strong>Qu\u00e8 passa si l&#8217;empresa no compleix l&#8217;obligaci\u00f3 de registre de jornada?<\/strong><\/p>\n\n\n\n<p>Hem preguntat al nostre assessor <strong>Perulles &amp; Moya <\/strong>qu\u00e8 passa si l&#8217;empresa no compleix el registre pel que fa a les infraccions. Aquesta \u00e9s la resposta:<\/p>\n\n\n\n<p><strong>Acta d&#8217;infracci\u00f3<\/strong><\/p>\n\n\n\n<p>Inspecci\u00f3 de Treball, quan constata fets que estima constitutius d&#8217;infracci\u00f3, el que fa \u00e9s <strong>estendre\/aixecar un acta d&#8217;infracci\u00f3<\/strong>, en la qual expressa els fets que considera infracci\u00f3 i proposa la imposici\u00f3 d&#8217;una sanci\u00f3. Per tant, si l&#8217;empresa est\u00e0 disconforme, pot formular <strong>al\u00b7legacions en un termini de 15 dies h\u00e0bils <\/strong>a contar des del dia de la seva notificaci\u00f3.<\/p>\n\n\n\n<p>Cal tenir en compte que la imposici\u00f3 de la sanci\u00f3 que correspongui en funci\u00f3 de la normativa legal aplicable correspon a <strong>l&#8217;Administraci\u00f3 Laboral <\/strong>(Departament de Treball).<\/p>\n\n\n\n<p><strong>Requerimets\/ advert\u00e8ncies<\/strong><\/p>\n\n\n\n<p>Depenent de les circumst\u00e0ncies, l&#8217;<strong>inspector t\u00e9 la possibilitat, davant determinats fets, de no aixecar &#8220;directament&#8221; <\/strong>o com a primera actuaci\u00f3 una acta d&#8217;infracci\u00f3, sino que pot efectuar <strong>requeriments\/advert\u00e8ncies,<\/strong> atorgant un determinat temps per &#8220;subsanar&#8221; la situaci\u00f3.
