{"id":16887,"date":"2020-02-13T11:03:25","date_gmt":"2020-02-13T10:03:25","guid":{"rendered":"https:\/\/fefac.cat\/empresarial\/?p=16887"},"modified":"2020-02-13T11:10:17","modified_gmt":"2020-02-13T10:10:17","slug":"mesures-urgents-igualtat-tracte-homes-dones-feina","status":"publish","type":"post","link":"https:\/\/fefac.cat\/empresarial\/mesures-urgents-igualtat-tracte-homes-dones-feina\/","title":{"rendered":"Mesures urgents per a la garantia de la igualtat de tracte i oportunitats entre dones i homes en la feina i l&#8217;ocupaci\u00f3"},"content":{"rendered":"\n<p>El pr\u00f2xim dia<strong> 7 de mar\u00e7 <\/strong>ven\u00e7 el termini perqu\u00e8 les empreses amb m\u00e9s de <strong>150 treballadors<\/strong><br>dipositin els seus <strong>Plans d&#8217;Igualtat<\/strong> en el Registre de Plans d&#8217;Igualtat de les Empreses, donant aix\u00ed<br>compliment al<strong> Reial Decret Llei 6\/2019, d&#8217;1 de mar\u00e7<\/strong>, de mesures urgents per a garantia d&#8217;igualtat de tracte<br>i oportunitats entre dones i homes en la feina i l&#8217;ocupaci\u00f3.<\/p>\n\n\n\n<p><strong>Plans d&#8217;Igualtat<\/strong><\/p>\n\n\n\n<p>Un Pla d&#8217;Igualtat ha de recollir informaci\u00f3 sobre la composici\u00f3 per sexe de les seves plantilles i sobre els salaris que reben homes i dones en l&#8217;organitzaci\u00f3. Amb car\u00e0cter previ a l&#8217;elaboraci\u00f3 cal fer un diagn\u00f2stic negociat amb la representaci\u00f3 legal de les persones treballadores.<\/p>\n\n\n\n<p>Segons el Reial Decret Llei 6\/2019, d&#8217;1 de mar\u00e7, els Plans d&#8217;Igualtat han de contenir un<em><strong> &#8220;conjunt ordenat de mesures avaluables dirigides a remoure els obstacles que impedeixen o dificulten la igualtat efectiva de dones i homes&#8221;<\/strong><\/em> entorn de les seg\u00fcents mat\u00e8ries: proc\u00e9s de selecci\u00f3 i contractaci\u00f3, classificaci\u00f3 professional, formaci\u00f3, promoci\u00f3 professional, condicions de treball, inclosa auditoria salarial entre dones i homes, exercici corresponsable dels drets de la vida personal, familiar i laboral, infrarrepresentaci\u00f3 femenina, retribucions, prevenci\u00f3 de l&#8217;assetjament sexual i per ra\u00f3 de sexe.<\/p>\n\n\n\n<p> <strong>En el suposat cas en qu\u00e8 l&#8217;an\u00e0lisi reflecteixi una situaci\u00f3 de desigualtat per g\u00e8nere, s&#8217;haur\u00e0 d&#8217;incloure un pla de com pensa l&#8217;organitzaci\u00f3 corregir aquestes difer\u00e8ncies a curt termini, <\/strong>han de recollir-se aquelles mesures concretes que s&#8217;implementaran per a esmenar aquesta situaci\u00f3 de desigualtat. <\/p>\n\n\n\n<p>Per a l&#8217;efectivitat i entrada en vigor de totes les mesures anteriors es va establir un p<strong>er\u00edode transitori a comptar des del 7 de mar\u00e7 de 2019 <\/strong>en funci\u00f3 del nombre de persones treballadores de les empreses:<\/p>\n\n\n\n<p>De 151 a 250 treballadors 1 any des de la data &#8211; 07\/03\/2020<br>De 101 a 150 treballadors 2 anys des de la data &#8211; 07\/03\/2021<br>De 50 a 100 treballadors 3 anys des de la data &#8211; 07\/03\/2022<\/p>\n\n\n\n<p> La <strong>Direcci\u00f3 General d&#8217;Igualtat<\/strong> ofereix <strong>informaci\u00f3 i assessorament <\/strong>sobre com ha d&#8217;elaborar-se un Pla d&#8217;Igualtat. Posa a la disposici\u00f3 de les empreses eines per a elaborar el diagn\u00f2stic, el disseny i el seu posterior seguiment i avaluaci\u00f3, aix\u00ed com el Registre P\u00fablic de Plans d&#8217;Igualtat. <\/p>\n\n\n\n<p>No complir amb aquestes obligacions, segons s&#8217;estableix en l&#8217;Estatut dels Treballadors, pot donar lloc a <strong>sancions <\/strong>econ\u00f2miques. La no elaboraci\u00f3 o la no aplicaci\u00f3 dels Plans d&#8217;Igualtat es considera una infracci\u00f3 molt greu. Les multes poden oscil\u00b7lar <strong>entre 6.251\u20ac i 187.515\u20ac<\/strong>, a m\u00e9s de la imposici\u00f3 d&#8217;una altra mena de <strong>sancions<\/strong>:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>P\u00e8rdua autom\u00e0tica de les ajudes, bonificacions i beneficis derivats de l&#8217;aplicaci\u00f3 dels programes d&#8217;ocupaci\u00f3.<\/li><li>Exclusi\u00f3 autom\u00e0tica de l&#8217;acc\u00e9s a aquests beneficis per un per\u00edode de sis mesos.<\/li><\/ul>\n\n\n\n<p>Les empreses que no tinguin un Pla d&#8217;Igualtat o que no el compleixin no podran contractar amb l&#8217;Administraci\u00f3 P\u00fablica, en compliment de la Llei de Contractes del Sector P\u00fablic.<\/p>\n\n\n\n<p><a rel=\"noreferrer noopener\" aria-label=\"Consultoria i Estudi Legal.
