{"id":226358,"date":"2020-12-07T10:19:12","date_gmt":"2020-12-07T09:19:12","guid":{"rendered":"https:\/\/fefac.cat\/empresarial\/?p=226358"},"modified":"2020-12-07T10:19:15","modified_gmt":"2020-12-07T09:19:15","slug":"empreses-exoneracio-acomiadaments-erto","status":"publish","type":"post","link":"https:\/\/fefac.cat\/empresarial\/empreses-exoneracio-acomiadaments-erto\/","title":{"rendered":"Les empreses tornaran les exoneracions si acomiaden un empleat en els 6 mesos despr\u00e9s d&#8217;un ERTO"},"content":{"rendered":"\n<h2 class=\"wp-block-heading\">PIMEC considera abusiva i desproporcionada aquesta decisi\u00f3<\/h2>\n\n\n\n<p><strong>PIMEC <\/strong>considera &#8220;abusiu&#8221; i &#8220;desproporcionat&#8221; el criteri de la Direcci\u00f3 General de Treball i la Direcci\u00f3 General de la Inspecci\u00f3 del Ministeri de Treball i Economia Social sobre els efectes que comporta el fet de <strong>no complir amb l\u2019obligaci\u00f3 de salvaguarda de l\u2019ocupaci\u00f3 de sis mesos de les empreses afectades per ERTO.\u00a0\u00a0<\/strong><\/p>\n\n\n\n<p><strong>El criteri fixa que la p\u00e8rdua d\u2019un sol lloc de treball comporta que s\u2019hagi de reintegrar la totalitat de les cotitzacions a la seguretat social exonerades, amb el rec\u00e0rrec i interessos de demora que corresponguin<\/strong>, i per totes les persones treballadores dels que s\u2019hagi aplicat l\u2019exoneraci\u00f3. Davant d\u2019aix\u00f2,\u00a0<strong>PIMEC considera que l\u2019afectaci\u00f3 hauria de ser nom\u00e9s cas a cas, i no per la totalitat de la plantilla<\/strong>. Aquesta\u00a0<strong>proporcionalitat<\/strong>\u00a0s\u2019ha de recollir tant en l\u2019import a retornar, com per ra\u00f3 de dimensi\u00f3 de l\u2019empresa, que \u00e9s tamb\u00e9 determinant en aquests casos.<\/p>\n\n\n\n<p>PIMEC defensa la import\u00e0ncia de preservar els llocs de treball i, especialment, les empreses que han pogut accedir a les mesures de regulaci\u00f3 temporal i bonificaci\u00f3. En aquest sentit, anuncia que inicia les accions per defensar els interessos de les petites i mitjanes empreses de Catalunya, at\u00e8s que&nbsp;<strong>les conseq\u00fc\u00e8ncies, per l\u2019ab\u00fas i desproporci\u00f3 en la seva interpretaci\u00f3, pot comportar la p\u00e8rdua de molts m\u00e9s llocs de treball que els que pretenia preservar en un inici.<\/strong><\/p>\n\n\n\n<p>Aix\u00ed mateix, en tractar-se d\u2019una interpretaci\u00f3 t\u00e8cnica,\u00a0<strong>PIMEC far\u00e0 la proposta de modificaci\u00f3 legislativa,\u00a0<\/strong>que d\u2019altra banda seria molt senzilla, als Ministeris afectats perqu\u00e8 amb la m\u00e0xima urg\u00e8ncia i per la via d\u2019un Reial Decret- Llei, es puguin donar les directrius per una
