{"id":5096,"date":"2014-10-08T15:09:40","date_gmt":"2014-10-08T15:09:40","guid":{"rendered":"http:\/\/fefac.cat\/empresarial\/?p=5096"},"modified":"2014-10-08T15:09:40","modified_gmt":"2014-10-08T15:09:40","slug":"el-govern-rectifica-i-no-permetr-els-terminis-de","status":"publish","type":"post","link":"https:\/\/fefac.cat\/empresarial\/el-govern-rectifica-i-no-permetr-els-terminis-de\/","title":{"rendered":"El Govern rectifica i no permetr\u00e0 els terminis de pagament superiors als legals"},"content":{"rendered":"<p>La Plataforma Multisectorial contra la Morositat (PMcM), a la qual est&agrave; adherida l&rsquo;AFB, ha expressat la seva satisfacci&oacute; pels canvis den el projecte de Llei de Foment de Finan&ccedil;ament Empresarial, doncs considera que &ldquo;impliquen un aven&ccedil; essencial en la batalla contra la morositat&rdquo;.<\/p>\n<p>Aquesta entitat, que representa a prop d&rsquo;un mili&oacute; d&rsquo;empreses, aplaudeix que el text hagi eliminat les disposicions relatives a la morositat que pretenien allargar els terminis de pagament si hi havia una cessi&oacute; del cr&egrave;dit a un tercer.<\/p>\n<p>Aquesta mesura hagu&eacute;s complicat la legislaci&oacute; en mat&egrave;ria de morositat i hagu&eacute;s perm&egrave;s legalment l&rsquo;allargament dels terminis de pagament, segons explica el president de la Plataforma, Antoni Ca&ntilde;ete, tamb&eacute; secretari general de PIMEC, que celebra que l&rsquo;Executiu hagi escoltat la queixa de la PMcM i de les pimes i aut&ograve;noms.<\/p>\n<p>Les dues disposicions permetien a les empreses pagar el seu deute comercial m&eacute;s enll&agrave; dels 60 dies fixats per la llei si hi havia un acord entre el deutor i el creditor per cedir el deute a un tercer, que abonaria el pagament en termini. Aix&ograve; hagu&eacute;s possibilitat que, quan es produ&iacute;s la cessi&oacute; del deute a un tercer (com per exemple succeeix amb el <em>factoring<\/em> o <em>confirming<\/em> bancari) es poguessin allargar els terminis de pagament, carregant els costos financers al creditor.<\/p>\n<p>Tot i que Ca&ntilde;ete considera que amb el projecte de Llei de Foment del Finan&ccedil;ament Empresarial &ldquo;es va en la bona direcci&oacute;&rdquo;, matisa que &ldquo;queda molt cam&iacute;
